Sexual Harassment Prevention Plan

New Mandatory Sexual Harassment Prevention Plan for Queensland

From March 1, 2025, all businesses in Queensland will be required to implement a Sexual Harassment Prevention Plan as part of updated work health and safety regulations. This new requirement is designed to proactively manage and mitigate risks associated with sexual harassment and gender-based harassment in the workplace.

What is Required?

Under the new regulations, businesses must:

  • Formally assess and manage the risks of sexual harassment in the workplace.
  • Implement effective control measures to prevent harassment.
  • Develop a written Sexual Harassment Prevention Plan that outlines policies, procedures, and actions to address and mitigate harassment risks.
  • Consult with employees and leadership teams to ensure a comprehensive and tailored approach.
  • Regularly review and update the plan, at least every three years or when new risks arise.
Who Does This Apply To?

The new requirement applies to all businesses operating in Queensland, regardless of industry or size. Employers must take proactive steps to assess workplace risks and ensure compliance with the updated regulations.

Penalties for Non-Compliance

Failure to comply with the new Sexual Harassment Prevention Plan requirements can result in significant penalties, including:

  • Fines and legal consequences under workplace health and safety laws.
  • Increased liability in cases of sexual harassment claims.
  • Reputational damage and potential loss of business credibility.
